Terms of Service

The terms that govern every Power100 site, program and service.

1. Who We Are

Power100 is a rankings, media and reputation platform for the residential home improvement industry. We publish the National Power Rankings. We produce articles, interviews and reports. We run paid programs that measure and build how a company is seen by the industry and by AI systems.

In these terms, “Power100,” “we,” “us” and “our” mean Power100. “You” means you. If you are acting for a business, “you” also means that business, and you are telling us you have the authority to accept these terms on its behalf.

2. What These Terms Cover

These terms apply to everything Power100 runs, including:

Using any of them means you accept these terms. If you do not accept them, do not use them.

3. The Product Agreements, And Which One Controls

Some products have their own agreement. Read the one that applies to you:

If a product agreement and these terms say different things, the product agreement controls for that product. These terms cover everything the product agreement does not.

4. Accounts, Sign-In Links And Verification

Some parts of our sites need an account or a verified identity. To claim a ranking, open a dashboard or submit a form, we may ask you to verify a phone number or an email address first. Verification is how we know you are who you say you are before we show you anything about your business.

We sign you in with a link sent to your email, and sometimes with a code sent by text. That link is personal to you and it expires. Do not forward it. Anyone holding it can open your account.

You agree to give us accurate information, to keep your sign-in details to yourself, and to tell us straight away if someone else gets into your account. You are responsible for what happens under your account.

We may suspend or close an account that breaks these terms or puts the platform at risk.

5. Text Messages From Power100

By consenting to receive text messages from Power100, you agree to the following:

7. Power100 Intellectual Property

The Power100 name, the Power100 logo, the rankings and the methodology behind them, PowerConfidence, Reputation Intelligence, our scoring systems, our reports, our articles, our site design and our software all belong to Power100. Nothing in these terms hands any of it to you.

If you are ranked, recognized or published by us, you may say so and link to your Power100 page. You may not change the ranking, restate it as something we did not say, or use our marks in a way that suggests we endorse a product or service we have not endorsed. Redistribution of our content beyond that needs a Power100 licensing agreement.

8. Content You Provide

You keep ownership of what you give us: your articles, your bio, your photos, your logos, your answers, your testimonials and anything else you submit.

You grant Power100 a perpetual, worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, edit for length and clarity, transcribe, excerpt, translate, publish, distribute and promote that content in connection with Power100 sites, programs, reports and media, and to let our distribution partners carry it the same way.

You confirm that you have the right to give us everything you submit, that it does not infringe anyone else’s rights, and that any person shown in a photo you supply has agreed to it.

We keep editorial control over what we publish. We may decline to publish something, edit it, or take it down.

9. Third-Party Services

We use other companies to run parts of our service. Payments are processed by Stripe, and Power100 never sees or stores your full card number. We also use hosting, email, text messaging, analytics and AI providers.

Our measurement work observes third-party AI systems, including tools like ChatGPT, Gemini, Perplexity, Claude and Google AI Mode. We do not own them, we do not control them, and we are not affiliated with them. They change without telling us, and what they say about any business can change with them.

10. The AI Concierge And Appointment Requests

The AI concierge answers questions about your account, your standing and our programs. It is informational. It is not legal, financial, tax, accounting or other professional advice, and it is not a substitute for your own judgment or your own advisors. Verify anything you plan to act on.

AI output can be wrong. Decisions you make from it are yours.

When you ask the concierge for an appointment, a demo or a call, you are making a request, not booking a confirmed slot. The request is routed to a person at Power100, and a person confirms it with you. Nothing is booked until you hear back from us.

Conversations with the concierge are stored and may be read by Power100 staff. See the Privacy Policy.

11. Disclaimers

Our sites, programs and services are provided as is and as available, without warranties of any kind, express or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise a ranking, a score, a citation in any AI system, a search placement, a lead, a customer, a media outcome or a revenue result. We describe what we observed and what we did.

We do not promise that the sites will be uninterrupted, timely, secure or error free, and we do not promise that a measurement taken at one moment will hold at another.

12. Limitation Of Liability

To the fullest extent the law allows, Power100 is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost data or lost goodwill, even if we were told such damages were possible.

Power100 is not liable for business decisions you make from our recommendations, our reports or our AI output, for the results of any introduction or match, for third-party content, products or services, or for interruptions, errors or data loss.

In no event will Power100’s total liability to you, for all claims taken together, exceed the amount you paid Power100 in the twelve months before the event that gave rise to the claim.

Some states do not allow some of these limits. Where that is true, they apply to you only as far as the law allows.

13. Indemnification

You agree to defend, indemnify and hold harmless Power100, its officers, employees, contractors and partners from any claim, damage, loss, liability or expense, including reasonable legal fees, arising from your use of our sites and programs, your breach of these terms, the content you submit, or your infringement of anyone else’s rights.

14. Termination

You may stop using our sites at any time. Paid programs are cancelled the way their own agreement says, and the Reputation Intelligence Terms explain how to cancel a subscription.

We may suspend or end your access if you break these terms, if you put other members or the platform at risk, or if we stop offering a service. If we end a paid program without cause, you get a refund of the unused part of what you paid in advance.

Content we have already published stays published. Sections 7, 8, 11, 12, 13 and 16 survive the end of these terms.

15. Changes To These Terms

We may update these terms. The current version is always on this page, with its effective date at the bottom. If a change is material, we will give notice on the site or by email before it takes effect. Continuing to use our sites after that means you accept the new version.

16. Governing Law And Venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules.

Any dispute we cannot settle between us will be brought in the state or federal courts located in the State of Florida. You and Power100 both agree to that venue and to the personal jurisdiction of those courts. If a product agreement you accepted requires arbitration, that requirement controls for disputes about that product.
