I. Introduction and Background
Purpose of Protection Max
Power100 has created the Protection Max program for the Nation’s leading remodeling companies. Utilizing our proprietary 5-layer ranking system, we’ve selected the top 100 companies for the nation’s consumers. Titan Siding and Windows, in Austin, TX, qualifies for our 100% Power Protection Max.
Ranking System Details
The 5-layer ranking system involves detailed assessments in areas such as quality, satisfaction, innovation, reliability, and financial stability. Continuous improvement is based on homeowners’ feedback.
II. Provisions for Homeowners
Scope of Work and Satisfaction of Craftsmanship
Project Completion: Power100 commits to completing the homeowner’s project in accordance with manufacturer’s specifications and the original scope.
Collaboration with Contractor: Active Relationship with Titan window and door to effectively communicate with ownership.
Homeowner’s Responsibility: The homeowner agrees to provide feedback for Power100’s ongoing efforts to improve its ranking system.
III. Purpose
Peace of Mind: Reassure clients among the top 100 on power100.io that they have chosen a reliable company.
In-Depth Vetting Process: Our ranking is based on rigorous evaluation, utilizing years of industry experience.
Agreement Period
Commencement: Becomes effective when the client registers a signed contract with Power100, within 48 hours or two calendar days of the appointment.
Termination: Concludes when the invoice is paid in full, or the balance reaches zero.
Warranty Limitations and Liability Exclusion
Warranty Exclusion: No extended warranty or guarantee beyond project completion. However, Power100 will always be a client advocate and mediator for escalated discrepancies between the Client and the Contractor.
Exclusion of Damages and Injuries: Power100 is not responsible for damages or injuries to any person, property, or thing at any time. Under no circumstance does liability transfer from Contractor to Power100.
IV. Contractor’s Insolvency Provisions
Adoption of Contract: If the contractor becomes insolvent, Power100 will adopt and see the completion the original scope of work.
Client’s Responsibility: The remaining balance must be paid before Power100 commences work.
Timeframe: Client has 30 days from insolvency notice to pay balance and engage Power100 for the completion of their project, if the Client chooses to utilize Power Protection MAX.
Project Completion: Power100 has one year or 365 days to complete the project, with a contractor of its choosing, from the day of payment.
Return of Payment: Power100 will not return any payments made to Contractor. Power100 is not responsible for any funds not paid directly to Power100. Power Protection MAX is here to ensure the project is completed to the original scope of work.
V. Quality Assurance and Dispute Resolution
Quality Commitment: Power100 promises quality work and will act as an advisor for minor discrepancies.
Discrepancy Resolution: Includes issues with caulking, paint, color matching, product imperfections, contract scope, and additional scope of work.
External Authorities: If changes are made due to external authorities, those changes will be upheld.
Unexpected Discoveries: If at any point in the project the contractor discovers something unknown, such as wood rot or building not to code, and this discovery causes the original scope of work to be put on hold, then this Power Protection MAX agreement is null and void until the client has the issue resolved, and the work can be completed. The homeowner has one year to continue the contract. Power100 is not responsible for any refunds, but will help mediate the situation to a fair resolution.
VI. Limitations and Liabilities
Outside Original Scope: If the homeowner directs work outside the agreed scope resulting in damages, all rights to reimbursement are waived.
VII. Miscellaneous Provisions
Compliance with Local Laws and Regulations: Both parties agree to comply with all applicable laws, regulations, and ordinances.
Confidentiality: Both parties agree to maintain the confidentiality of all information shared.
Force Majeure: Neither party shall be held responsible for failure or delay in performance if caused by unforeseen occurrence.
Jurisdiction and Governing Law: Governed by the laws of the state where the project is located.
Amendment and Modification: Modifications must be in writing and signed by both parties.
Entire Terms and Conditions Acknowledgement: Supersedes all prior discussions, emails and/or agreements.
